Paintings of M F Hussain

Naked Bharatmata - Hussain has shown naked woman with names of states written on different parts of her body. He has used Ashok Chakra, Tri-colour in the painting. By doing this he has violated law & hurt National Pride of Indians. Both these things should be of grave concern to every Indian irrespective of his religion.

Hussain hates Hitler and has said in an interview 8 years ago that he has depicted Hitler naked to humiliate him and as he deserves it ! How come Hitler's nudity cause humiliation when in Hussain's own statement nudity in art depicts purity and is in fact an honour ! This shows Hussain's perversion and hypocrisy.

M.F. Hussain or Maqbool Fida Hussain, the great painter of India, now in his nineties has always been known for his paintings, exhibitions and controversies. Though I used to revere him much previously and liked his infatuation for Madhuri Dixit but I lost all my regard and respect for him when I witnessed his above described nude and denigatory paintings. Hussain has been in controversies since a long time, perhaps since 1982 when he made his first naked painting which depicted his anti-Hindu nature for the first time. Very recently he again invited the ire of the Hindus by making a painting of naked Bharat Mata, which I would say was really a very shameful peace of work on his behalf. It now seems that Hussain has developed some form of proclivity of insulting Hindu gods and goddess. A number of anti-Hindu paintings have been made by him, all have been pasted above. Now, the readers are left to themselves to decide that whether Hussain is a skunk or a mercy deserving person.

Perusal of the Paintings

If one goes through the paintings minutely then one hall find that most of the gods and goddess, which are revered the most by the Hindus, have been painted full naked and some are even shown having sex with animals. This is really the worst form of insult which a person can do. It is noteworthy that it is Hussain only which initiated the depiction of our gods and goddess in such a way. The opposers may argue that nudity is a part of Hinduism and Ellora and Ajanta caves contain nude idols and sculptors. It may be true that nudity may be a part of Hindu culture but the intention and the way in which the depiction is done is to be considered.

There is a big difference between what Hussain has painted and what is there in Ajanta and Ellora. The idols, sculptures of Ellora and Ajanta depict an art, a creation which are a part of life. They were created in good faith only to understand the different facets of life. The most important thing is that they were created with a bona fide intention and not with any other evil feeling. In Hussains paintings the opposite holds true. He made paintings only to insult the Hindu gods and goddess, which a person can easily gauge by looking the paintings above. I have following queries to Mr. Hussain:


1. Why almost all gods and goddess have been shown naked?
2. Why goddess are shown having sex with animals?
3. Why some gods or eminent Hindu persons have been shown decapitated?
4. Why is a Muslim women shown in full clothes?
5. Why is a Christian Mother Teresa shown in full clothes?
6. Why are Muslim poets shown decently and not Gandhi and Hitler?



I invite Mr.Hussain to answer my questions and if gives a satisfactory reply to me or to the people in general then I would withdraw my article from the blog.

Hussain-------A True Muslim

Very few people know that Hussain is a five time namaji, which shows his hardcore commitment towards his religion. Now his paintings have confirmed that he is only a true Muslim. It is widely known that Muslims love to flout, insult, denigrate and belittle all religions except Islam. The same thing was done by Hussain too. Muslims have no respect for any other religion or any idol or any God except their own. This is evident from many instances----destruction of Bamiyan Buddha in Afghanistan by Taliban, destruction of temples in India by Muslims when they were the rulers, continuous plummeting and destruction of the temples in Muslim nations, attacks on Churches and Gurudwaras in Muslim countries etc. Hussain falsely proclaims that he respects all religions and believes in multi-religiosity and muti-culturalism. He advocates widely that a nation should have a multi cultural society. All his claims remain absurd and this is proved by my two simple questions:

1. Why don’t you visit Temples, Church, Gurudwaras etc?
2. Why did you depict only Hindu Gods and Goddess naked and with contempt?
It would be senseless to go in detail to prove his nature of a true Muslim. One may argue that he is a modern man, with most advance life style and way of living. He also has one of the most modern thoughts. It may be accepted that he has a most modern life style and modern thoughts but does that mean that he does not believe in Islam or he has forgetted his religion. What is the guarantee that if a person is very modern and advance then he does not believe in his religion?. I think that this all remains suffice to confirm that he is a true Muslim and is thus serving his religion, by hook or by crook.

Why are Muslims silent?

As said previously, Muslims like insulting other religions. So, if their co-religionist does the same thing then should they protest against it? The answer which can be anticipated is only a big “NO” and exactly this happened. Islam asks Muslims not to oppose their co-religionist, howsoever wrong they may be and this was only done by the fellow Muslims. It should also be noted that in our daily life if we find any Muslim committing any wrong then any other Muslim will always try to defend his co-religionist, directly or indirectly. Few months ago, the world witnessed huge protests and processions when Denmark, a Christian nation published the photos of Prophet Mohammad, with a bomb on his cap. There were fatwas, widespread processions, slogans against Denmark and Christians from every Muslim nation. Even the Muslims of India did not lag behind. There were processions, effigy burning by Muslims in India too, where they are considered as a minority.

One of the third grade Muslim politician raised a bounty of Rs. 50 Crore for the person who can slit the throat of cartoonist which made the cartoon of Prophet Mohammad. This all only confirms the aggressive nature of Muslims and their lopsided mind to destroy the non-Muslims. The opposite happened in case of Hussain. Muslims are well aware that M.F.Hussain has made the naked paintings of Hindu Gods and Goddess. But they never came forward to condemn him. Muslims did not raise any fatwa against him. There was not a single voice of protest against him. There were no mass protests, no processions, no effigy burning etc by Muslims. This shows the inherent implied support of Muslims to Hussain. In law, omission to commit an act is also considered as an act. Here too omission to support Hussain becomes an indirect support to Hussain. People well know that remaining silent on any issue means that person supported the issue.

The Best Punishment

I believe in tit for tat. Husaain has committed a grave wrong and for this he should get the punishment.He has insulted the feelings and sentiments of the crores of the people and so people should have the right to grant him the punishment. He has committed the offence twice and that too intentionally. So, the best form of punishment for him would be to take away his life. To deal with the Muslims, it is pivotal to deal in their own way. That strategy can only work. Being lenient has always cost us and it is still proving hard on us. So, Hussain deserves to be killed now. His offence is grave and serious. The most important thing is that he has committed the offence twice and that too intentionally. A person may be pardoned once but not twice. Hindus showed mercy on him by leaving him in 1982 but now when he has again committed the offence, he deserves the harshest punishment.

Hussain is already on the right side of nineties and he can live for a maximum 5 or 6 years. After that he will die on his own. Even if people kill him, he will loose only 5 or 6 years of his life. He will not be deprived much of his life because most of which he has already lived. Moreover, this will also act as a deterrent to others. Minorities never act against the majority community in any country. This is the general rule in almost all the nations but it is really a pity that the opposite is taking place in India.

Readers may not agree with my form of punishment. They will talk of law and legal procedure. That procedure is also acceptable to me provided that it is done in an expeditious way and there remains a guarantee that the culprit will definitely be punished. It is not as if I dont believe in law but there are certain things which have to be don’t outside the law also. Everything cannot be done according to the law. People know very well that legal recourse in India takes sufficient time and this cannot be denied. For urgent disposal of issues like that of Hussain we need to go outside the law only. This has been done in most of the nations.

Uproar over Umar-Priyanka Issue

Few months ago, people witnessed a huge uproar in the trendy city of Bhopal over an issue. The issue was marriage of a Sindhi babe, Priyanka Wadhwani with a Muslim lad, Umar. The marriage proved to be unacceptable to the members of the Sindhi communities and Hindu organizations and they came to the forefront to raise a voice against such inter-religious marriages. I think that I would be doing injustice to the readers if I won’t discuss the details of such an issue. Priyanka Wadhwani was a college going girl, hailing from the Sindhi community. She had a nuptial tie with Umar, a man belonging to the Muslim community. As the news about it spread like a fire in the city, Sindhi and other Hindu organizations started making processions, protests with trenchant criticism of such a union. It is alleged that they started receiving threats for their life because of which both finally eloped to Mumbai. They had also filed a writ petition in the High Courts of Jabalpur and Mumbai. The courts had upheld the validity of such marriage and ordered Police for providing the young couple ample security. As expected the lopsided media covered the issue in niceties, getting a suitable opportunity of upbraiding and smirching the Hindu and other organizations.

The issue involved two things: 1. Marriage of a Hindu girl with a Muslim boy and 2.Marriage of a Sindhi community girl with a boy outside her community. My article shall deal in detail with both the issues but we should first consider the validity of such a marriage. The Constitution of India, the most sacred official document provides a person of majority the right of marrying any other person of his choice. Similarly the Special Marriage Act, 1954, which is enforceable in India, provides that a major person can marry any other person of his choice, irrespective of his colour, creed, religion, race, community, region etc. In my standpoint the rights provided are fully legitimate, legal and valid and the union of Priyanka and Umar was in full compliance with Special Marriage Act and the Constitution of India. They did not flout any law but despite this the Hindu and other organizations kept protesting. Prima facie their protests appear to be totally vague, useless and the organizations are branded as anti-Constitution, anti woman and opposers of liberty of a person. This all was exploited by the biased media to portray such organizations in bad image. On a deeper analysis of the problem, one can easily fathom the logic behind such protests and can conclude that the demands are fully legitimate, valid and genuine.

Though I believe in the Constitution of India as well as in other statutes and I do revere the rights provided by them but such inter-faith and inter-religious marriages receive my crutch only when none of the two parties have any interest or any wicked feeling or any furtive motive regarding the religion or faith of other, which is present in majority of the cases. Reverting to the two issues involved, the former one was

1) Marriage of a Hindu girl with a Muslim boy

Overtly the union of such type appears to be fully tenable with no problem but on a deeper analysis it is a grave threat to the Hindus. As pointed out by me earlier, in such type of cases the primary intention wicked. It is the conversion of the faith of the spouse. Marriage becomes a secondary issue here.

A Muslim marries with a Hindu person not out of any affection, feeling or love but with a clandestine motive of converting the spouse to his own religion i.e. Islam. This tendency is present in almost all Muslims and Christians, though exceptions are also visible. It is one of their wicked plans of reducing the Hindu population by marrying people of other faiths and ultimately forcing them to give up their faiths and embrace Islam. People may not be aware but about 1 Lakh Hindu girls get converted to Islam or Christianity every year in India only after marriage. In Bhopal only about 350 girls converted to Islam in the year 2006. The Hindu organizations feared for this thing only and this made them to protest. I have personally heard Muslims saying that their sole object behind such marriages is to increase the people belonging to their faiths. All topmost Muslim Bollywood actors like Shahrukh Khan, Salman Khan, Aamir Khan, Saif Ali Khan etc seem to be working with the same agenda. But since they are plutocratic and elite members of the society, who enjoy modern and swanky life, therefore they cannot impose their religion on their spouses (they being equally modern and any force may result in split) but on the other hand they are dead sure that at least their children will be officially Muslim by religion because a child’s religion is that to which his father belongs. Thus they are bit successful in increasing the people of their faiths, at least officially if not practically. People like Nasruddin Shah are very few who give their children the freedom to choose their religion. If such conversion keeps on happening unabatedly and without any protests then one day Hindu population will become a minority in its own land. Therefore such protests become fully genuine, though appear to be unnatural and illegal.

2. Marriage of a Sindhi girl outside his community

In the former case, when Umar finally converted to Hinduism (the vicious attempt backfired in this case) queries arose as to why Hindu organizations were still protesting against such marriage. The question appears to be legitimate and tenable but can be answered if we consider the all circumstances and situations in detail. Even after the conversion of Umar to Hinduism, it was the Sindhi organizations which were protesting. No purely Hindu organization like RSS, VHP Bajrang Dal etc protested after the conversion of Umar to Hinduism because they realized that the marriage was done not with any vicious motive but out of true love and affection. Therefore they withdrew but the Sindhi organizations continued with their protests.

The reason behind continuation of such protests was simply that they did not want the girls of their community to marry any man outside the community. They would not prefer to marry their girls even to a non-Sindhi, a marriage with a person of another religion becomes a pipedream for them. Indian society is not an open society. The people here care more for their values, culture, norms etc and India is known across the pan world for this trait only. Every community has the right to preserve its own culture, tradition, values, mores etc. In a caste ridden society, where marriages are done within the members of the same caste or communities, a community too has the right to preserve its own culture etc. In the same way, Muslims prefer to marry with a Muslim person only. A person who flouts this rule is often sacked from his community. A Kashmiri Muslim would like to marry his daughter with a Kashmiri Muslim boy only and not with a Bihari Muslim or a Tamil Muslim. Similarly, a Gujarati person would like to marry his children with Gujarati person only. A Tamil Brahmin girl would prefer to marry with a Tamil Brahmin boy only and not with a Brahmin lad of North India. A Saudi Arab boy would like to marry with a Muslim girl of Saudi Arabia only and not with that of India. It has become a general rule for the people of India, though exceptions are always visible.

In the same way, a Sindhi community, which is already a small one, too has the right to preserve and protect its culture and mores. By making such violent protests and by imposing a code of conduct on Sindhi girls, the protestors simply want to deter the girls from inter-religious or inter-cultural marriages because such marriages would prove to be a threat to their own culture, traditions etc. A person who goes against the interests of the community has to often face the wrath of the senior members. The same happened with Priyanka and Umar. When Umar changed his religion to Hinduism, he was thrown out of his community because of two reasons: 1) The desire of increasing a person to his faith, which was expected by the members of his society had vanished. 2) He himself renounced his religion, culture, values etc and chose to adopt Hinduism and thus married a girl outside his community, without creating any positive result. Young people who are in true love may compromise with their cultural traits but the agile members will never accept it. They will always retaliate because they want to protect their own identity and traits.

Kaun Banega Crorepati-III

Kaun Banega Crorepati(KBC) has been one of the very famous and widely viewed TV shows, having achieved a larger than life image. The first two versions were anchored by Mr. Amitabh Bachchan, the most famous icon of the Indian cinema ever produced. I was much jubilant to know some time ago that KBC was coming again. My dreams of learning and enjoyment got stifled when I came to know that it will be headed by Mr. Shahrukh Khan, in lieu of Mr. Bachchan. I was dead sure that Mr. Khan, who though zingy but garrulous and non-serious would not be able to match Mr. Bachchan and my belief came true when I watched KBC for some days. I had such a standpoint about Mr. Khan only when I saw his movies. I had surmised at the very beginning only that the platform of KBC would be used by Mr. Khan to not only target Mr. Bachchan but also to promote his Muslim clique. The KBC smacked of such propaganda from the very beginning. The cussed behavior of the anchor forced me to pen down and expose the non-serious, uncultural and hidden attitude of the anchorman.

Before the programme was telecasted a lot of hype was made by the media regarding Shahrukh Khan replacing Amitabh Bachchan. The common masses too had expected a lot from such a change, perhaps because the public today looks for a younger face everywhere but I am sure that their expectations must have got vanished( which I got confirmed by reading the epistles to the editors of various periodicals) by Mr. Khan’s overall demeanour. I must confess here that I have watched very limited shows of KBC but I could fathom his overall conduct. Though Mr. Khan’s introductory and concluding behavior was all right and he deserves admiration and applause for that but his conduct at anchorman’s seat and his way of talking with the contestants at the hot seat showed his true colours, his education and upbringing. His behaviour with both the men and women (most of which were Hindus) was devoid of any respect and full of sarcasm. His total conduct appeared to be against the spirits, values, ethos and culture of India. While Mr. Bachchan addressed every person as “Aap” either he may be a child, women or an old person, Mr. Khan used to address the contestants at the hot seat as “Tum” (perhaps because he considered himself superior to others). While Mr. Bachchan used to refer even inanimate objects with respect e.g. Computer Ji for the computer, Mr. Khan could not even revere the human beings. The statements of Mr. Khan such as “Tum kya karogi itne paise jeetkar”, “Tumhare yahan kya famous hai”, “Tumhe kya pasand hai”, “Are yaar, ghabrao nahi, aaram se baitho”, “Kya soch rahi ho”, “Idhar udhar kya dekh rahi ho”, “Confuse ho gayee kya”, “Are yaar jaldi socho” etc showed his way of dealing with the common people, especially with women and his manners and etiquettes.

Mr. Khan always had the desire of hugging and kissing the women (People must have seen him doing this when women used to leave the hot seat). His hugging and kissing the women at the forehead were too cheap antics expected from a celebrity like him. I remember Mr. Khan had asked for a hug from Mrs. Rachna Sharma(when she was about to leave from the hot seat), a teacher in late thirties. His request was turned down in a straightforward way by Mrs Sharma. Her terse and curt reply jolted him. His frequent flying kisses to the audience, which generally consisted of a whole family, was really deplorable. His singing songs, dancing before the public etc became a common thing. Mr. Khan should have known that KBC is being watched by person of every age group and it is not a movie. Here his actions are his own and have not been mandated by a director. A person is judged only through his actions and open kisses etc is against the rudiments and mores of India, which is still not an open society. I remember, a person had made a request to Mr. Bachchan to dance over the song “Kajrare”, which was rejected tersely by him but it looked as if Mr. Khan was always ready to holler and perform such silly vulgar antics, crossing all the limits of morality, latitude and formality.
Mr. Khan even did not have the basic sense of dressing. His apparel was totally informal. Shirts were coloured instead of being vibrant. Coats were expensive. It looked as if he wanted to display his wealth there. He also used to behave in a quirk way sometimes. He used to dance on the floor several times. At the last show, he gyrated round the hot seat saying “Balaclava, Cardigan, Balaclava, Cardigan repeatedly (these were the options to a question).

Mr. Khan also appeared to be communal and selfish in his overall approach. In the show, the very first couple to be invited was Arbaaz Khan and Malaika Arora Khan. Even in the concluding session, Salman Khan and Katrina Kaif were summoned. While Mr. Bachchan had invited people from various field e.g. Madhuri Dixit, Sania Mirza, Sachin Tendulkar, Lara Datta, Priyanka Chopra etc, Mr. Khan was communal enough to invite people mostly either from his Muslim community or Bollywood( It being so because he wanted to improve his relations with the eminent personalities). At he very last show, two girls, Priyanka Chopra and Kareena Kapoor were also called but their session lasted for only 1 hour while that of Salman Khan and Katrina Kaif lasted for about 1 hour and a half. This all shows his sinister motives of working in a public platform.

One more mean act on the part of Mr. Khan was his feeling of chauvinism and megalomania. Mr. Khan always used to admire himself. He kept self praising himself. His statements such as “Do you see my movies”, “Am I your favourite hero or not?”, “Would you not like to dance with a handsome person like me?”, “Would you not remember your meeting with a big hero like me at the hot seat?” etc shows that he wanted to hear his admiration only from the public. He wanted to portray himself as the best actor of Bollywood( even surpassing Mr. Bachchan). He used to chuckle a lot when any contestant showered praises on him. Mr. Khan even had the hidden intention of self promotion by using the platform of KBC. The assertive statements such as “Watch my movies”, “Do everything but also watch my movies” etc shows his motive of self promotion. I do recapitulate a request made by Mr. Khan to the father of a Ghaziabad boy to let him see the movies otherwise his business will come down. These all incidents show his intention of commercializing a family programme and to derive maximum mileage out of it.

Mr. Khan even did not have the manners of talking on phone. He used to say, “Mr. X, How are you? I am Shahrukh speaking from KBC………?” There was no greeting, no proper introduction. Even jokes on the phone were also demeaning. He used to ask from the person on phone as to whether he watches his movies or not, which confirmed his intensive publicity campaign. The type of response which Mr. Bachchan used to receive was never received by Mr. Khan, at least on phone, because people knew his non-serious nature.

Let me now focus on the behavior of a so called very good friend of Mr. Khan, Mr. Salman Khan. Mr. Khan had called Salman and his girlfriend Katrina Kaif, only because he wanted to improve his relations with Salman Khan ,which some time ago were a strained lot. While I have no grudge against Katrina Kaif because she behaved in a decent and very well way, but Salman Khan to all my expectations transgressed all the limits. Salman Khan’s behavior looked as if he was a rustic person with improper learning. Muslims feel proud of him but to my utter surprise he even did not know the Arabic name of Jerusalem, which is one of a most holy place for Muslims. The most derogatory and mean act was done by him when he said “Perhaps my mother may be reading Hanuman Chalisa, that’s why I am unable to answer the questions”. This was really a hurting statement. The only meaning which I could fathom from his statement was that since his mother is reading Hanuman Chalisa, which is a non-religious book for Muslims, therefore he was unable to answer the questions. Even if it was done in jest, then I ask should the religious scriptures be commented before answering anything. I wonder Muslims would have issued a death fatwa against any Non-Muslim person if he had referred to Quran in a sarcastic way or even in jest. But unfortunately, Hindus did not resent against it.

Salman Khan too like his brother, Mr. Khan behaved in a quirk way. He in one scene said to Mr. Khan “If you are so intelligent then why don’t you tell the answer”, which shows their conduct among themselves. He in another scene shouted “Balaclava, Cardigan, Balaclava, Cardigan repeatedly. He in another scene tried to copy Mr. Bachchan by saying “Hey Kahin jaana nahin, hum abhi lot kea ate hain”, in the tone of Mr. Bachchan. Salman Khan was even funnier than Mr. Khan. He also said once to Mr. Khan “Abe Katrina does not know English, you can say anything to her.

The overall behavior of both the Khans was really disgusting and contemptible. It looked as if both were trying to settle some scores from Mr. Bachchan with some hidden agendas. The overall response of such a presentation was that viewership of KBC slumped after a certain period of time and Star Plus began to face losses because of which KBC ultimately closed down within four months. While during the tenure of Mr. Bachchan, Star Plus had made huge profits and even Mr. Bachchan was able to pay back all his debts, during the term of Mr. Khan everyone got fed up soon and viewership decreased which ultimately resulted in closure. Such a behavior from modern persons like Mr. Khan, Salman Khan etc confirms the mindset of a Muslim mind, which always considers Non-Muslims as arch rivals, and both the Khans are no exception to it. I hope that the Khans will improve themselves. Merely looking good in the movies is not sufficient. One should be good in behavior and in the real life too.

Time to shed image of a soft State

India has been a victim of terrorism since late eighties. It has bleeded enough with copious major terrorist attacks. Attack on Akshardham Temple, attacks in the various Hindu holy cities such as Ayodhya, Banaras etc can be mentioned as few archetypes. The potential and the enormity of hatred which the terrorists have and with which they can attack India was realized by the Indian Government on 13th December,2001, the doomful day when armed terrorists tried to sneak into the Parliament. The western world rose from its slumber after the occurrence of 9/11 and it has since then taken effective measures to deal with the menace of terrorism. The regretful thing is that our Indian government still continues to be non-serious in dealing with one of the biggest and the dangerous problem of this world.

India has already been declared as a target enemy, numbered at 3 by the Al-Qaeda and other Muslim terrorist organizations. Terrorist and other fanatical organizations have taken the pledge of destroying India. Their rhetoric cum speeches are suffice to establish their hostility. Their continuous attacks, bomb blasts etc proves their commitment for their cause. In such a situation, does India should remain a soft target or should it adopt the policy of tit for tat like Israel and USA? The query still remains to be answered. Where the menace of global terrorism remains on the upsurge and with the various nations adopting and drafting the anti-terror laws, India’s repealing of the Acts like POTA, TADA etc shows the seriousness of the Indian government towards the issue. The failure of the government in getting the attacks purged, in getting terrorists nabbed and punished, the exchange of the hardcore terrorists for few people, the shoddy investigations conducted, the use of the obsolete guns and the lack of modern arms and anti-terrorist weapons with the Police, the sluggish response of the Police etc are some of the things proving the lackadaisical attitude of the government.

The intensity of attacks and proxy wars has plummeted on the borders but has increased inside the country today, raising the risk for the lives and property of the innocent citizens of the country. In such circumstances and conditions it is high time for the government to adopt a policy of harshness and strictness. The terrorist deserve no sympathy. They are anti-social elements which are hell bent on destroying the peace and order in the society. The terrorist deserves no right to live. They are a threat to the people, to the institutions, to the government, to the property of the country and such evil minded persons should be treated with severity. Unfortunately the slow response of the government has provided an impetus to the militants to continue with their activities. The successful bomb blasts done by the terrorists, their going scot-free and uncaught, frequent killing of the innocent people and military forces etc acts as a moral booster to them. This all forces them to act more vigorously to create chaos in the society. This all can be lessened only if government treats them severely.

Various measures can be adopted to deal with this vital issue. Government should treat the anti-national elements iron-handedly. Encounters of such people should be done frequently. The capital punishment should be made a general rule for them and life sentence should be awarded only in the rarest of the rare cases. There should be no human rights for such people, who don’t revere and care for the human rights of others. While the innocent people should not be targeted in guise of rooting this evil but the culprits should not be let free under any cost. The defense forces and the Police should be made more free and autonomous in their decision making and working. More special anti-terror forces should be established or if this is not possible then their units should be increased.

If the government does not shed its soft image then it will continue to be inflicted with such terrorist forays. The innocent people will be liquidated more and more and there will be processions and demonstrations against the government. Ultimately government will face the wrath of the people only after parting with the precious lives and property of the people. Not only this, the terrorists will continue damaging the governmental institutions and economy and this will also slow down its rate of growth. It will also cost the government millions of pounds which shall be a big loss for a developing economy like India. The condition is so grave that these anti-national elements, which were confined to the borders few years ago, have made their burrows inside the country now. If they remain unchecked they will one day attack and destroy pivotal institutions like Nuclear Plants, industrial and economic institutions like RBI, SEBI, BSE, NSE, banks etc. This will only create an international image of India of being a soft target, which will make it prone to more such attacks. It is high time to provide not only ample security measures to pivotal institutions but also to liquidate the open enemy and the termites which are working day and night against the country. The intentions of such wicked people need to be smothered and stifled at the earliest just as Israel and USA does.

Long Vacations of Higher Courts

As the summers arrive every year, one of the points on which i really ponder over is “Do the Higher courts really deserve long holidays”? Being a law student the point appears to me to be legitimate and tenable and thus needs to be expatiated so as to arrive at a final decision. The article presents my own views, which strongly contend for the working of the courts without unwanted long holidays.

Our Indian Judiciary is often excoriated for taking a long time in the disposal of the cases. Even celebrities and moguls do not get justice before five or six years have elapsed. The Jessica Lal case, the Mattoo case, the Bombay blast case are some of the paradigms which vehemently support the claim. One of the factors responsible for taking a long time in the final adjudication of the matters is huge litigation. Our courts are already inundated with cases and matters in dispute. There are about 40,000 cases pending in the apex court, about 35 Lakh cases in the various High Courts and about 2 Crore cases in the district courts of the country. The vastness in no. very lucidly shows that how much efforts are coveted for the settlement of matters in dispute. While multifarious solutions are offered for the problems mentioned above, some of which may be appointment of more judges, establishment of more courts, improvement in infrastructure and way of working, cutting down of frivolous matters, settlement of disputes outside the courts etc but not much is emphasized on the scrapping of holidays for the higher courts, may be because of the fear of the Contempt of Court. Even the Law Minister, Mr. Hans Raj Bhardwaj has openly stated such measures but he too evaded from emphasizing on scrapping holidays.

While every govt. deptt. works today throughout the year, it is high time that the Courts should also be made to function for the whole year just as the other organs of the government do. There should not be any special favour given to the Courts, they being pivotal organ of the government and because of the respect and faith they command in among the general masses. Going back to the history of such long vacations, it were there from pre-independence time. From the very establishment of the court system, which commenced in the mid 19th century, only Britishers were appointed as Judges. The British Lords being from the colder regions could not bear with the climate of the summers, which was extremely hot, humid scorching and unbearable. Therefore the English judges used to spend two months of their summer time in the hill stations like Nainital, Mussorie, Shimla etc. Their position and condition appears to be justified and tenable considering their point of view. This continued for a long time and thus there developed a custom of having holidays during the summer season. The same custom continues till today while the position has changed a lot. Today, the Judges of the Supreme Court and High Courts are not Britishers, rather they are Indians and therefore they are aware about the Indian climate. A person must adapt itself to the existing aura and the higher court Judges too must learn to live in an ambience where climate remains hot for most of the time. The Judges should consider themselves as an ordinary citizen of the country and must face the problems as other people do. I too feel very hot and uncomfortable and I hate the summer season in which sweat and foul smell becomes a common thing but that does not mean that I will cease my work because of the inclement climate. Work has to be done and there should not be any excuse for that. While western and the European countries have maximum 2 or 3 official holidays every year, our country continues to have maximum no. of declared official holidays. Every unwanted holiday makes Govt. poorer by about Rs.1000 crore. This may be one of the reasons why western countries have progressed so much and India still continues to be a developing economy even after having copious talent and manpower. Once a Chief Justice of India commented regarding Saturday holiday that it is justified because the higher court judges work very hard and therefore they deserve Saturday as a holiday too so as to rejuvenate themselves. Point conceded but what is the relevance of having holidays for a long time in summers?

Summer holidays for apex court lasts for about 45 days. The pack up work begins from 15th May and the courts get closed by 18th or 20th May till 1 July every year. The High Courts function for some more time. They get closed by about 25th May and open in the last June or early July. During the winters too both the SC and High Courts get a one week holiday.

The Supreme Court is fully air-conditioned, the chambers of the Lords are also air-conditioned, their cars are swanky and luxurious and even their houses do have at least two air conditioners. They do come to the Court in their cosy cars, have their lunch in their chamber and work in the courts. Thus right from 10 a.m. in the morning till 4 p.m. in the evening they work in air-conditioned buildings. There is also a generator facility for the Courts. Almost same is the condition with almost all the High Courts. Judges who really face the unbearable scorching summer season are that of the District Courts but they do not get any holiday for that. Neither do they make any claim for that.

Ramifications

Let me focus on some of the consequences of such unwanted holidays. During the summer vacations, in Supreme Court only one or two judges preside for the adjudication of emergency matters. Similarly in High Courts too very few judges opt to work. This results in undue pending of the matters in dispute, which causes harassment to the parties and also adds to the backlog, which is already a giant no. A person who wants immediate relief is told to come in the month of July when the courts shall reopen. There can also be no decision on any Constitutional matter during such time. While Supreme Court has it self said that right to speedy trial and early judgment are to be enjoyed by the parties but at the same time the same court prolongs the matter for the sake of their enjoyment in the holidays. This happens not only in the apex court but also in the various High Courts. This causes problems to the parties and also belittles their faith in the system. Seeing the judges enjoying in the summers makes the officials of the other departments jealous. They also start demanding for breaks which is not feasible. If every person will ask for holiday then who will work? So considering all these points, the vacations need to be scrapped as soon as possible.

Conclusion

Lastly, I would say that Courts should itself scrap the old custom of holidays. By this it would not only earn encomiums and credit but would also solidify the faith of the people in the Judicial system, which is already loosing its gleen because of multifarious factors. This would also result in the settlement of many cases which shall reduce the overall burden on the Judiciary and remove the backlog. Even if this is not acceptable then one week holiday of December can be shifted to the summer season. During such one week holiday, the higher court Judges can visit any hill station and enjoy the cold weather there. This shall act as a change in their business and will also rejuvenate and restore the working potential and spirit in them. The Judges should realize that they hold a Constitutional position and by every way they should consider themselves equivalent to the other servants of the government without claiming any special privileges since they already enjoy much.
